Recently, someone contacted me to complain that he was fired without reason. Although it is unfair for your employer to fire you without reason, legally it is not considered wrongful dismissal. Shooting someone without “good reason” is legal in almost every state. In fact, an employer can fire someone for no reason, for bad reasons, or even for intentional misconduct.

If you’ve been fired, you may want to know, “How do I know if I’ve been wrongfully fired?” Getting fired is stressful and traumatic. But before contacting an employment lawyer, it’s important to understand the difference between mere unfair termination and an actionable wrongful termination.

A question that many people who have been fired have: How do I know if I have been wrongfully fired? This is a common question to ask. But there is a huge gap between the public perception of wrongful dismissal and the legal definition of wrongful dismissal.

The legal definition of wrongful termination is very specific. Unless your dismissal meets certain criteria, you may not have legal remedies.

This is what is considered wrongful dismissal: your employer fires you for an illegal reason. In practice, this means that your employer must break the law for unfair dismissal to be an unfair dismissal.

As I often tell potential clients, “Legally, you can be fired for good reason, bad reason, or no reason at all.”

It is frustrating when you realize that your company is doing something wrong but they are not breaking the law. So how can you tell the difference between being fired for bad reasons and for illegal reasons?

These are the two most common reasons people contact me about wrongful firings: mean bosses and false accusations. In most cases, neither meets the legal definition of wrongful termination.

Stories about bad bosses are very common. Some bosses are never satisfied with their employees. And sometimes, that means owners can cross the line into abusive behavior like yelling or bullying.

The phrase “hostile work environment” seems very apt for these situations. Bosses can turn a professional, productive workplace into a stressful, toxic environment through their actions. But unfortunately, in most cases, having a mean boss, even a very cruel and dominant one, is not considered a hostile work environment. And it is perfectly legal for a mean boss to fire an employee for no reason or even worse for a reason they know is wrong.

“My colleagues falsely accused me and now I am fired.” This is a situation I see often. But the law does not protect employees from being fired after a false accusation.

Does this mean supervisors can fire workers for false accusations? It may sound unbelievable, but your employer can legally fire you for a false allegation, even if you can prove that it is false.

Unfortunately, employers can fire employees for unfair reasons. For example, your boss may fire you because they don’t like you or because you’re not “right” for the role.

But it is important to take a closer look at these examples of unfair dismissal. Unfair dismissal is illegal if your boss fires you on the basis of disability, race or membership of another protected group. And not being the “right” person is often a harbinger of discrimination based on gender, race, or sexual orientation. In my experience, it’s not unusual for people who are fired for discrimination to be told they’re not a “fit.”

Unfair dismissal can look a lot like wrongful dismissal. Here’s a recent example from my job: An employee complained to human resources about his boss’ bad behavior at work. Then the boss fired them.

Reasons Employees Can Get Fired

But did it end wrong? Unless the worker complains about illegal behavior — such as sexual harassment, workplace discrimination, shareholder fraud or wage theft — the supervisor can legally fire the worker, regardless of the worker’s performance. How good or how long the employee’s track record is.

Can you sue for wrongful termination as an at-will employer? At-will employment stipulates that employers can fire employees for any reason. But you can file a wrongful termination lawsuit at your discretion. This is because even in states with at-will rights, employers cannot fire employees for illegal reasons.

State laws provide additional protection. For example, in New York, you are protected from wrongful termination if you complain about an illegal act. In New Jersey, you are also covered if you complain about your employer doing something unethical.

Let’s go back to the first question: How do I know if I’ve been wrongfully fired? Before contacting an employment attorney, ask the following legal questions about wrongful termination:

The Set Up To Fail Syndrome

This can be a difficult question to answer, especially if your employer doesn’t give a reason. But let’s dive deeper into the circumstances surrounding your dismissal. Is your termination part of a larger layoff? Are you implementing a performance improvement plan? Or are you on the exam? In most cases, employers can legally fire employees under these circumstances.

Did your employer violate your rights or break the law when they fired you? Unless you’re an employment lawyer, you probably don’t know the answer. But there are some clear warning signs that your firing may be against the law.

Consider this situation: You recently complained to human resources or your boss about discrimination, wage theft, or other violations. Then your manager fires you. This can be considered as revenge firing.

Or consider another situation: Your boss recently complained that you’re not “right for the job,” meaning it’s because of your gender, race, or age. If you are fired, it may be a unfair dismissal.
