He was taken to a nearby hospital where doctors declared him dead, his family told the court in the application.

The family of the deceased, including his wife, parents and sister, claimed that the accident happened because of a “sudden and careless reaction” by the driver of the car (jeep) who committed the act.

Therefore, they jointly demanded a compensation of Rs 2 crore from the vehicle owner and the insurance company.

The court rejected the insurance company’s defense that the accident was caused solely by the negligence of the deceased driver.

“The material on the record indicates that at the time of the accident, he (the jeep driver) drove the vehicle too fast without following the flow of traffic on the road,” it said.

Therefore, the owner of the offending vehicle and its insurer are jointly and severally liable to pay compensation of Rs 1.36 crore, plus interest, to the petitioners, the court ordered.
